Sexual Offences

As of July 13, 2011, Ohio Law classifies Sex Offenders under 6 Classifications. Sex offenders are classified as: Tier 1 Offenders, Tier 2 Offenders, and Tier 3 Offenders or Sexual Oriented Offenders, Habitual Sexual Offenders, and Sexual Predator.

The different in the classifications are when the offense occurred. If the Offender’s offense occurred before July 1, 2007 they will register as one of the following: Sexual Oriented Offender, Habitual Sexual Offender, and Sexual Predator. If the offense occurred after July 1, 2007 the classifications are Tier 1 Offender, Tier 2 Offender, and Tier 3 Offender.

 

 

We feel it is important for the citizens to understand the above classifications. They are as follows:

SEXUAL ORIENTED OFFENDER: Anyone convicted of or pleads guilty to committing a sexually oriented offense as defined in Ohio Revised Code number 2907.01, which includes rape, sexual battery, gross sexual imposition, regardless of the age of the victim. Some other offenses include kidnapping, abduction, unlawful restraint, criminal child enticement, corruption of a minor, compelling prostitution, endangering children (victim under 18 years of age), pandering obscenity, minor pandering sexually oriented material, illegal use of minor in nudity-oriented material/perform. Sex offenders must register with this office once a year for ten years.

HABITUAL SEXUAL OFFENDER: Any person who is convicted of or pleads guilty to a sexually oriented offense and who previously has been convicted of or pleaded guilty to one or more sexually oriented offenses. Habitual Sex Offenders must register with this office twice a year for 20 years. If a judge so rules, community notification may occur.

SEXUAL PREDATOR: Any person who has been convicted of or pleaded guilty to committing a sexually oriented offense and is likely to engage in the future in one or more sexually oriented offenses. Sexual Predators must register with this office every 90 days for life. The Sheriff’s Office will also require a vehicle license plate number, and will also verify the home address of an offender within three days of registering with this office. Community notification will occur with every sexual predator.

 

TIER 1: Offenders is subject to the registration/verification requirements annually for a period of 15 years following their initial registration. These offenders are not subject to neighborhood/community notification.

TIER 2: Offenders is subject to registration/verification requirements every 180 days (six months) for a period of 25 years following their initial registration. These offenders are not subject to neighborhood/community notification.

TIER 3: Offenders designated as a Tier 3 Offender are subject to registration/verification requirements every 90 days for life. Tier 3 offenders are subject to the neighbor/community notification provision which includes all residents within a 1,000 feet radius of where the offender is residing.
